Who Reported Me to CFS? Confidentiality and Custody Disputes in San Bernardino County
In most cases, CFS will not tell you who made the report. California Penal Code section 11167(d) keeps a mandated reporter’s identity confidential, with narrow exceptions, and members of the public can report without giving a name. Trying to guess who called, or confronting them, usually hurts your case.
Who usually makes reports
Teachers, doctors, nurses, therapists, police officers, and many others are mandated reporters under Penal Code section 11165.7. Neighbors, relatives, and former partners can report too. Hospitals such as those in Loma Linda and Colton see children with injuries or positive toxicology, and those contacts often begin a referral.
What you can and cannot learn
- You can usually learn the general allegation so you can respond.
- The name is generally withheld. Exceptions include a court order or the reporter’s waiver of confidentiality.
- In a court case, your lawyer gets discovery that may reveal more, though reporter details are commonly redacted.
When the report comes from your ex
Custody fights are a recurring source of referrals. If you suspect your co-parent called, do not accuse them, and do not contact potential reporters. Doing so can be recorded as hostile or retaliatory. Instead, bring your lawyer the timeline: custody filings, exchanges, prior reports, and messages.
What can be done about a false report
- Show the worker the context through counsel, including a pattern of reports timed with custody hearings.
- Family Code section 3027.1 lets a family court impose money sanctions against a person who made an accusation of child abuse or neglect during a custody proceeding that was false and known to be false.
- Mandated reporters have broad immunity under Penal Code section 11172. Other reporters are protected unless the report is shown to be false and made knowingly or with reckless disregard.
- If a dependency case is open, the juvenile court generally has exclusive jurisdiction over custody issues (Welfare and Institutions Code section 304), so timing and venue matter.
Family court and CFS at the same time
Statements made to CFS can show up in the family law case and the reverse is also true. One lawyer or a coordinated team should see both files. Read false CPS allegations in San Bernardino and our page on cross-county custody issues in Chino Hills.
Frequently asked questions
Can I sue the person who reported me?
It is difficult. Reporters have statutory protection, and mandated reporters have broad immunity. Talk with a lawyer about your facts.
Can I get a copy of the report?
Access is limited during an investigation. Your attorney can explain how to seek records, and what is available changes once a petition is filed.
Should I confront the person I think called?
No. It can be used against you and rarely helps.
